TALKING POINTS

The 2010 Kenyan Constitution safeguards the right of all children born and residing in Kenya to education. The new Education Bill of 2012, signed into law in January 2013, provides for the right of a child to access basic education, which is defined to include pre-school, primary and secondary education.

The Kenyan government’s refugee policy has also evolved over time. While the Kenyan government has been historically a relatively hospitable host to refugees coming into the country, recent violence in Kenya attributed to the group Al-Shabaab has made the Kenyan government to call for the refugee camps to be closed down and for urban refugees to be returned to their countries of origin, despite international humanitarian law preventing these actions.
